HC directs CEO Anantnag to implement directions on private tuition ban

High Court directed the Chief Education Officer Anantnag to adhere to the directions of the court with regard to imposing a ban on private tuition to the students in the district.

The father and guardians of the students have assailed the validity of Circular bearing No. CEO/A/IMW/32359-550/21 dated 12th of January, 2021 issued by the Chief Education Officer Anantnag, in terms whereof the Teachers/ Lecturers have been directed to desist from giving tuitions to the students.
Justice Ali Mohammad Magrey while deciding the petition after hearing the counsel Sheikh Umar Farooq on behalf of the aggrieved petitioners directed the Chief Education Officer, Anantnag to adhere to the directions of the Division Bench passed in 2017 with regard to the issue.
The Division Bench of high court has declared the action of the Government as regards imposition of complete ban on private tuition vide circular dated January 4, 2017, being unsustainable under law, accordingly, quashed the same and allowed the writ petition.
“These writ petitions shall stand disposed of with direction to the Chief Education Officer, Anantnag to adhere to the directions of the Division Bench as aforesaid”, Justice Magrey directed.
Court after going through the objection taken by the Chief Education Officer, Anantnag against the petition said, he could not justify the action which is in violation of the directions passed by the Division Bench of this Court.
“Needless, to mention that the Chief Education Officer, Anantnag has to adhere to the Rule 10 of the Rules of 1971 by ensuring that the Government teachers while deciding to go for private tuitioning, shall obtain proper permission in this regard in tune with the circular issued by the Government in the year 2005 dated 11th of August, 2005, whereby all Government teachers were allowed to undertake tuitions with the rider that they shall not undertake the tuitions two hours before the opening of the schools and two hours after closure of the schools”, Justice Magrey added.
